It's not part of the government's proof in seeking to initially block the deal. They have to show market power (of Google) and a lessening of competition (or damage to competition in the defined market). What is the market? How is it damaged? If the market is world wide text ads on web pages, it gets more difficult to prove damage to competition because the people hurt are one level down--the business that buy ads. Google and Yahoo are more like ad brokers. I also think DOJ will work something out rather than both sides going to the mat.
